Family Law - Just What Is It?
Traditionally what most people think of as a Family Law case is a "divorce" case. Divorce, now known as a dissolution of marriage, is the legal proceeding brought by either spouse to terminate a marriage. This term includes the dissolution of a domestic partnership.
Along with the termination of the marital (domestic partnership) status, many other issues are decided such as the division of assets, debts and liabilities, a determination of an appropriate amount of spousal support (alimony as it used to be called) and/or child support if any, and child custody and visitation. These same determinations are made in a Legal Separation action. The difference is that a Legal Separation does not terminate the marital status, but seeks the same protection of the law with regard to custody, support and division of marital assets and debts.
